Why Device Security Matters

Your phone contains sensitive information that could be used against you or others:

  • Contact lists and call history
  • Text messages and chat apps
  • Photos (including location data)
  • Email and documents
  • Immigration case information
  • Location history

At the border (ports of entry), CBP has broad authority to search devices. In the interior, ICE generally needs a warrant, but device seizure still occurs.


Immediate Actions: Secure Your Phone Now

1. Use a Strong Passcode (NOT Biometrics)

Face ID / Touch ID Avoid Can be physically compelled

How to disable biometrics quickly:

iPhone:

  • Press and hold Side button + Volume button for 2 seconds
  • This temporarily disables Face ID/Touch ID

Android:

  • Press Power button 5 times quickly (varies by model)
  • Or: Settings → Security → Lockdown mode

2. Enable Full-Disk Encryption

iPhone: Automatically encrypted when passcode is set.

Android:

  1. Settings → Security → Encryption
  2. Enable "Encrypt phone"
  3. This may take 1+ hour - keep plugged in

3. Disable Lock Screen Notifications

Prevent message previews from showing without unlocking:

iPhone:

  • Settings → Notifications → Show Previews → "When Unlocked"

Android:

  • Settings → Lock Screen → Notifications → "Hide content"

Secure Communication Apps

Use end-to-end encrypted messaging for sensitive conversations:

Signal Settings for Maximum Security

  1. Enable disappearing messages (24 hours or less)
  2. Enable registration lock (Settings → Privacy → Registration Lock)
  3. Disable link previews
  4. Enable screen security (prevents screenshots)

Before an Encounter: Emergency Preparation

Create an Emergency Lockdown Plan

  1. Memorize your attorney's number (don't rely only on phone)
  2. Set up emergency contacts who can access your case info
  3. Back up important documents to secure cloud storage
  4. Enable Find My iPhone/Android for remote wipe if needed

Sensitive Data Checklist

Review and remove if possible:

  • Acceptable: iCloud (with Advanced Data Protection), Google Drive
  • Enable: Two-factor authentication on all accounts

During an Encounter

At the Border (CBP)

Reality: CBP has broad authority to search devices at ports of entry without a warrant.

Your options:

  1. Comply and unlock - They can copy contents
  2. Refuse to unlock - They may seize the device for forensic search
  3. Say nothing - You cannot be compelled to provide passwords (5th Amendment)

Best practice:

  • Travel with a "clean" device if possible
  • Back up and wipe before crossing, restore after
  • Know that refusal may cause delays but cannot be used to deny entry to US citizens

In the Interior (ICE)

Your rights are stronger:

  • ICE generally needs a warrant to search your device
  • Ask: "Do you have a warrant to search my phone?"
  • Say: "I do not consent to a search of my device"
  • Do not unlock your phone for them

If they seize your device:

  • Note the officer's name and badge number
  • Ask for a property receipt
  • Contact your attorney immediately
  • Do not provide the passcode

If Your Device Is Seized

Immediate Steps

  1. Do not provide the passcode
  2. Request a property receipt
  3. Document officer names and badge numbers
  4. Contact your attorney
  5. Change passwords for all accounts accessible from that device

After Seizure

  • Change passwords for: Email, social media, banking, cloud storage
  • Enable additional security on remaining accounts
  • Notify your attorney about the seizure
  • Consider a forensic search may reveal deleted data

Legal Protections

  • Riley v. California (2014): Police generally need a warrant to search phones
  • 5th Amendment: You cannot be compelled to provide passwords
  • Note: Biometrics (face/fingerprint) may be compelled in some jurisdictions

Privacy Settings Checklist
